okay what about if i restore the 3gs back to 3.0 and use redsn0w to jailbreak it then ultrasn0w to unlock it ?

You can't restore the 3gs back to 3.0 since apple isn't signing old versions for the 3gs anymore. You just need to be patient and wait on the dev team to come up with a jailbreak for 3.1.

ohh.. well right now i currently don't have an iphone.. but what if i buy an iPhone 3G refurb from at&t would it ship with os 3.0 which i can jailbreak using redsn0w?
