They haven't switched it...yet.

In all honesty here, I don't use enough data while tethering for AT&T to even bother switching me over. They are going after the top 5%, for which I don't even come close. With the amount of data that I use every month, I'll be on the grandfathered unlimited plan until they switch everyone off altogether.

It's already known that this top 5% thing is bunk and that they are going after a much broader spectrum of user...you'll be switched to a tiered plan in time, enjoy you unlimited data plan, that you don't use anyways, while you can...lol.

ever since i went Pure and no longer use MyWi i have been flirting with the 2GB mark so if/when it happens i'll already be prepped?

Thought I'd interject here. AT&T has no plans that Ive been made aware of to take away unlimited data after a contract expires. None. Zero. Nada

People out of contract are at a higher risk of churn, it wouldn't make sense to actively kick them out the door. It would make sense to show them the benefits they're getting by staying with AT&T, a la Unlimited Data.

Agreed. If they were doing that, I would have had my unlimited data plan removed a long time ago, as I have been with AT&T for a long time and never had a contract with them at all.

Exactly correct. You will not be booted if you have the plan regardless if you are under contract or not. I'd you have it, you will keep it. If you are one of those who push your luck with a ton of data usage you will get a friendly warning but they will not just take it away without notice.

Now what is a possibility is if you switched over to LTE, when that becomes available, you get forced to a tiered plan. Then again you could transfer your unlimited to HSPA+ plans so maybe not...

For the moment I think it's safe to say that AT&T won't remove unlimited data plans even if we did switch to LTE. Verizon let their unlimited data plan customers keep their unlimited plan even after switching to a LTE device. Seeing as how it's a carrier see carrier do world these days, I think AT&T will follow the same practice for now....

I'm not 100% sure that's true.

If AT&T considers unlimited data a contract feature, then yes, we could all walk (where are we gonna go?). If it is considered an add-on (we are paying extra fees for data, unlimited or otherwise), I'd say it would not constitute an adverse material breach of the contract. We can add/remove data plans or change plans at will. (Yeah, I know the part about a smartphone and a mandatory data plan, but we can pick any one we want, or downgrade to a non-smartphone and drop data altogether, without any impact on our contract status.)

But either way, I don't see AT&T changing it anytime soon.

But I'm not a lawyer, don't play one on TV and didn't stay at a Holiday Inn Express last night, so I could be wrong.

This is total BS. I spoke to someone at the AT&T Specialist dept (whatever that is) over the weekend and told me that they are working to correct this with more bandwidth, towers, backbone ect... I told them I didn't believe that hogwash.

The disturbing part is that there is no way for AT&T to prove you are in the 5%. What's even more BS is that 2GB plan subscribers are the base of that calculation. So when you go over 2GB on an Unlimited plan, you are automatically red-flagged. It was designed to fail your Unlimited plan from the get go.
This IS a cardinal change to your plan.

Spoke to AT&T yesterday

Yeah, I have to disagree with this. I can renew my contract right now and transfer over my existing unlimited plan.

And regards to throttling. I don't think it is that big of a deal honestly. I use 8-10 gig a month and think I will be fine. People who use a tremendous amount of data might be hit but those are people who tethering a lot of prime targets I believe. For the record I never tether.

Havent seen anyone post this up...so let me be the first to tell you that is not true at all. For awhile i thought if you went over the 2gb, as everyone had experienced, you got the text of being Mr. 5%....till this morning...I emailed Rene Ritchie about this....see picture below...
