JailBreak a Refurb ATT 3GS

I am considering come over to the dark side. I am on Sprint and thinking of moving to ATT and the IPhone, but I want tethering like a lot of people. I am a network admin and need to be able to get into our network from almost anywhere. If I buy one of the ATT Refurbed Iphone 3GS will it have frimware lower than the 3.13 so I might be able to Jailbreak the phone?
