urgent help!!!

hii guys
i am getting an iphone from u.s my friend is bringing it 4 me to avoid import duty he is bringing it unboxed as to pretend he is using it.
my question is
1) how can i get to know that the i phone he is bringing 4 me is not second hand i.e it is not used
2) can we find out that at what date it was 1st opened/started..

is there any provisions ?

Who cares if it's used or not? If it works with you SIM card installed, and has no physical damage to it and it meets your expectations, what's the difference?
