Why can't I get past the icloud terms and conditions on Apple TV when signing in to iCloud?

When I am setting up my Apple TV I want to set the screen saver to use my photos, on signing in to iCloud I click to agree the terms and conditions but it keeps sending me back to the Disagree/Agree screen.

Try restarting the AppleTV either via the menu or just pull the power..Wait 30 seconds...plug in again.
