I would say the art assets themselves, while different are still plagiarism of the original game.
It's like I would draw Mario a bit different from what it's drawn in a Nintendo game and everyone would recognize it's Mario look alike and I would claim it's a different character.
There might be even some level design similarities.
The difference with flappy bird is that the guy of flappy bird doesn't care about his stolen IP, but SEGA might care.
Also didn't Apple remove most of the flappy bird clones?
If SEGA finds out about this game it might have to sue him to protect their IP.

My intention was never to infringe any IP. Honestly, I searched for Alex Kidd in the App Store because I wanted to buy it. When I saw it didn't exist, It got me wondering if I should just try and create something similar myself. No code or artwork was copied, everything made from scratch, Alex Kidd was simply used as my inspiration. Consider it a homage to my favourite childhood game.
I'm currently working on the v1.2 update, which I think is going to include some new original level designs. If anybody has any feedback, I'd love to hear it and it could make it into v1.2
