iPhone browser error with new 3GS boot rom?

I have a new iPhone 3GS and just recently did a tehthered jailbreak. All jailbroken apps are working fine but when I open iPhone browser, the latest version, in the status bar lower left hand corner it says my iPhone is not jailbroken. It says there is no rfc2 file or something. I need to be able to modify the library directory where themes and such are stored.

Basically I want to be able to import a winterboard theme that I created which is not downloadable on cydia. I've heard you can ssh files but is that my only option. If so how is that done?

You need to add ACF2 via Cydia.
