Yes, the previous owner of the phone is the only person that can help you with this. There is no way around it.

If the device was purchased through a reputable site or company, then they should be able to "release" the device from then so you can obtain ownership.

Otherwise, you may be out of luck.

No one here at iMore will attempt to assist you in bypassing an iCloud Activation Lock for obvious reasons. With that being said, either return the device and get a refund or if you brought it from the alleged owner, have him or her disable the activation lock.
