just incase somebody answers this...which I don't think will, store bought 3.1.3 to 4.0 never jailbroken...possible to jailbreak?

Nope. Currently, only way to have JB OS 4.0 on 3GS:

1) Be currently running JB OS 3.13 or older on old bootrom.

2) Restore using custom JB OS 4.0 firmware.

I expect a jailbreak for OS4.0 to be released "soon", but probably after Apple pushes out 4.0.1.
