3G S speaker not working, will a new phone be jailbreakable ?

So the speaker of my 3G S isn't working. So no sound when playing games and no speaker phone. My real question is if I take it to Apple and get a new/refurb, will that phone be jailbreakable ?

I love my jailbroken iPhone and need it to run certain apps.

Any advice is always appreciated.

No, well it can be but it would need to be tethered each time you reboot or it wont work

Tough to say - I just picked up a 32gb 3Gs from my local AT&T store last wednesday and it had 3.1.2 installed so it was jailbreakable, but I gotta think that the majority of the new ones coming out are going to have 3.1.3 installed so won't be.

Is there a way to restore back to factory without downloading and installing the new 3.1.3 firmware ?
