Do you have to update to the new version 9.0.1 or is it on the phone? If you do have to update is it better to restore from backup and then update or to update, set phone up as new, and then restore from backup?

It was already on mine, when I got it.
I restored from a previous backup (8.4.1 on my 5S) and it worked great but I had to update ALL my apps =P

Some devices will come with 9.0 and others will have 9.0.1.

So remember when trying to setup and restore. Update first.

when setting up the new iPhone the first thing it does is update the phone to the latest os.. after I selected restore from iCloud

I set up my new phone as a restore from my current 4s. It is stuck on the slide to upgrade screen, I have tried to reset, restore, etc and I'm getting nowhere. Brand new phone is a paperweight.
