iCloud no password removal ?

Hello, my friend bought an iPhone which has an iCloud password which the previous owner forgot, I was wondering is it able to remove it on any way or if it is able to jailbrake it or install a custom iOS ?

If the previous owner can not remove the activation lock - which is what's going on here - the device is useless - and the friend should get their money back, and give the device back to the person that sold it.
