will not let me use latest back up from icloud to transfer my to data to new iphone

I am trying to transfer my data from iPhone 4s to my new iPhone 5s using icloud but won't let me select latest backup.

Is your current firmware the same as the one you backed up? Say if your backup is on 9.2 but your 5s is on 9.3.2 you will not be able to transfer.
