Try the apple store in Union Square. Didn't buy it from them this year, but last year they seemed to have pretty good supply on second day after launch.

They seemed to have a better supply of iPhone 4S's last year than the 5's this year. I guess it's because the demand for the iPhone 5 is much higher than the 4S was last year.

Apple isn't selling off contract iPhone 5's here in the US on their online website or via the app after 10pm. If you need to pay full retail for it you are going to have to keep trying the local stores in your are.

Buy online with an contract, then don't pay your sub .. you'll have an iPhone 5 for only 199$ , what i did (in France)
