This is frustrating, yet not surprising. Of course, companies can lie. Just look at the nutrition labels on food packaging and all the deceptive labels out there. The long road of marketing is littered with false claims, bait and switch and the best of intentions. One more reason that the US needs GDPR, (General Data Protection Regulations) like the EU.
