if I restore my iPhone and choose "restore from iCloud", will it load my current iOS which is 6.1.2 or will it automatically install 6.1.3?

I really do not want to lose my jailbreak. My iCloud is backed up with iOS 6.1.3.

Restore backup? Or restore?

Backups just replace the backup data. Full restores update to the current iOS.

You're right, but I understand the OP to simply want to restore from a backup and specifically, an iCloud backup.

I want to restore the phone in iTunes. After I do that doesn't it give me an option to "restore from icloud or set as new"?

In your initial post, you basically stated that you made a backup on a device containing iOS 6.1.3 and want to restore it to a jailbroken device running iOS 6.1.2 using iTunes. Well, according to THIS (The second line under Resolution), you cannot restore a backup from a newer version of iOS to a device using an older version of iOS. I can only assume it's whether the device is jailbroken or not.

I made a backup of 6.1.2. When I clicked "restore" it actually stated "the newest software will be loaded". So I guess it would install 6.1.3 on my phone thus breaking my jailbreak.

I had a backup on 6.1.2 and got a new phone still on 6.1.2. Icloud wouldnt allow me to backup via my phone. When I went onto itunes on my pc it allowed me to restore from my computers backup. Didnt say anything about firmware update and had me scared. Still on 6.1.2 :D So happy
