You should be able to "Cancel" the upgrade request, and select the "Do not ask again" box to keep from getting prompted for the update again. It shouldn't keep you from opening up iTunes and using it.

3.1.3 hasnt been jailbroken yet and may never be. so if you install 3.1.3 you will NOT have a jb iphone anymore.
