I've only tried using it when it's charging. is that the same thing or does it have to be in a car

Unplugged "hey Siri" only works on the 6s/6s+ - prior models have to be plugged in to a power source.

You need to enable "hey siri" in settings. If it was enabled in iOS 8 previously, you need to do it again on iOS9...

settings > general > siri > allow "hey siri"

you will then be prompted to train siri to recognize your voice

Could be a number of things...I'd try a hard restart, and if that doesn't work, a restore. Mine works perfectly fine when plugged in (which, in my opinion, kind of defeats the purpose of the function, but thankfully that was remedied on the new devices).
