I have a messy child custody case long distance, my sone had his own IPad where we would face time. His Step father controls everything now and has taken his ipad away for that purpose, now I have to talk to my son via his step father phone and I seen a weird message quickly looking like my ex wife phone has also connected and she and her husband can see/ listen my conversations with my son? is this possible? if they close the video how can I tell if a 3rd party is connected?

If the FaceTime call is being held in a Group iMessage chat thus making it a Group FaceTime call, there's really no way around that. Anyone who is apart of that group can join in on the conversation. The indication you'd have would be the audible chime that indicates a member has joined. I also believe there will be a ring around their icon that shows they are in the call if they didn't join with video.
