Jailbroken phone and apple care

I need to send my iPhone in for repair. I am going to restore the phone first, but I am wondering if when I get it back will it be my old one or a referb? Will it be updated to the latest iOS?

More than likely you will get a refurb. And more than likely it will be updated to the latest iOS. It just depends a friend mine walked into an apple store for a problem with his iphone and they swapped him out with a refurb. It still had 4.3.3 on it event though 4.3.4 had been released about 2 weeks earlier.
