Is it permissible in the Apple Developer's TOS for a developer to declare an app is compliant with an iOS version that's still in beta and not even at GM yet?

There were some problems with the notification system of the beta5 that we managed to find a way to solve them today. Declaring compatibility is an indication to our customers that we are working hard so that the app will be updated to support the OS5 ASAP the new OS is accessible from the iTunes store.
