so i've read about the probelms some people were having with the new update 3.1 if i buy my 3gs in nov. will it already come with the 3.1 update and if so will i be able to jailbreak eventually... new to all this that i'm reading

When you buy your iPHone it will come with the current firmware. And you will have to check it that firmware can be jailbreak and/or unlocked.

It will depend on whether or not all the current 3GS in stores now have sold out by the time you go shopping in November. If they have cleared, and new stock has been shipped in with the new firmware...you'll have the new firmware. I would say the chance is excellent as fast as iPhones sell.

Hopefully you'll be able to jailbreak. The dev team is hard at work on that now.
