Orange Pay as you Go Price, Unlocking New iPhone 3GS

Ok I have two issues that I'm hoping you can answer.

1. If I buy a new iPhone from an Apple Store, just say for instance, they have the latest firmware on or 3.0.1 or something similiar. Which ones won't I be able to jailbreak and unlock? I don't want to buy a Pay as you Go iPhone 3GS for it to be as useful as a paperweight.

2. I am wondering whether to wait for Orange to stock the iPhone, I'm wondering if anyone has any idea whether they will stock it cheaper on Pay as you Go compared to Apple themselves. I know that's probably a stupid question but I don't know what to expect from companies these days.

The 3GS will likely be on 3.1 or 3.1.2. Neither of these are unlockable at this point in time.

Only upgrading from 3.0.1 is available then? I can't downgrade and then upgrade?
