There have been many charts on tech blogs prior to this mornings preorder that claimed if your upgrade eligibility fell after 1/1/11 you would qualify for the 399 early upgrade price. However whenever I go through the preorder process, AT&T says my only option is no commitment, was i lead astray or has anyone else been able to preorder with an early upgrade discount?

i feel left out :-(

If your renewal is after 2010, you have the no-commitment pricing (no discount). My wife is in that category but I was able to order mine today... even tough we got ours on the same day.

(assuming you pass the credit check) or pay what AT&T calls the "early upgrade" price. It's more than the new activation price, but it's still better than the full price of $599 / $699 -- the only downside is that your current contract is extended to a full two years again from the date of your purchase. This early upgrade pricing comes in at $200 more than the $199 / $299, which means you'll pay $399 for the 16GB iPhone 4 or $499 for the 32GB version.

so i wasnt the only one fooled by such a chart/article?

I guess im the only one with this problem, everyone else whose eligibility date falls after 1/1/11 is obviously being able to upgrade for 399 early upgrade price?

I think the statement was if you upgrade date was BEFORE 1/1/11, i.e. in any time in 2010, you would be able to get the iPhone at the time of release. That is how I read it. Think about it why would they not give the upgrade to those who upgrade date is in september of 2010 but would to any one in 2011. Doesn't make sense.

My eligibility date comes up in 02/2011 but when I go to the apple website they are giving me the no-commitment price of $699 for the 32G. The ATT site, obviously, isn't working for upgrades right now.
