I have a question..suppose I use my upgrade for an iphone

however my intentions are to unlock the iphone and send it over to someone overseas. will I still be chardged the $30 for the data plan?

I believe the data plan is a must for the life of the contract, unless you can somehow show AT&T that the phone is no longer in your possession, or not being used on their network.
