It doesn't indeed. It says: Enter your Apple ID to get started.
But at the bottom, there's "Forgot Apple ID?"

You make it sound as though a thief only need know the owners name to retrieve an ID.

Let me clarify... I believe you can also use any email address listed as a rescue email address with that particular Apple ID as well.

Hi!

You can contact Apple along with a proof-of-purchase and they should be able to help you. They require proof of purchase because Activation Lock is designed to prevent theft, so stopping anyone who isn't the owner from unlocking it is the whole point.

If you bought a locked phone, contact the seller and either get them to unlock it, or get your money back. Sadly, people sell locked phones at a discount, and they're little more than paper weights at that point.
