Here's how...

Go to Settings>> Remotes and Devices>> Remote (battery picture)>> click that and see what version you have...

If you see something lower than firmware version 0x0245 - hit menu to go back, then tap the play/pause button 4 times... and it will update when your AppleTV is in sleep mode - may take up to half an hour... later - check the firmware version and see what you got...

It has extra *codes for more sound bars. And its the touch surface is supposed to track better.

*Codes may not be the right word to describe it. Basically it's supposed to work with more sound bars. So if you're having problems it's worth a shot to update the firmware.

Will be Apple TV let you know that there's a new version for the remote or do you have to keep checking. when you update the main software does that do the trick or do you have to update the Remote separate

It's supposed to update on its own like the regular tvOS updates. This firmware update was supposed to happen right after the tvOS 9.2 update. For some it did, but for others it didn't. I bet  will fix that for the next tvOS update. You can't expect Muggles to update firmware especially since the steps to do it aren't obvious. I doubt the tv will ever let you know there is a firmware update since the tvOS updates are supposed to handle it.
