unlocked/jailbroken ipod on t-mobile

If i buy a unlocked/jailbroken ipod for t-mobile do i have to have some sort of data/internet plan through t-mobile to use the internet and download apps?

Is this illegal or violating my contract?

Do you mean iPhone? If you do, You do need a internet [Wi-Fi or Edge] connection to use the internet and/or download apps.

And yes, you do. You'd have to go to T-Mobile and purchase their "smartphone plan" if you have a monthly subscription, and if you gofor a prepaid plan, you an use the prepaid smartphone plan or the sidekick plan.
