I have a Iphone 5. I belonged to my son. He no longer uses it. Do I have to have a contract to turn it on

No. Just insert a valid sim. It should activate. If it's Sprint (and maybe even Verizon), it may need to be activated in store. But you should be able to use it for your phone regardless.
