Volume Button not working very well

The down volume button on my iphone 5 doesn't work unless pressed really hard but when I turn my phone on and off it works perfectly for like 5mins then goes back to not working is it ios 7 or my phone

Open Settings, then Sounds.
Under ringers and alerts, adjust the volume with the slider and see if problem persists.
Also, maybe toggle Change with Buttons off and then on.

It's hard to say if it's the phone or the os. Try rebooting the device.

Contact apple and set up a genius bar appt. They should be able to narrow everything down and see if you should get a replacement or not.

Is take the phone back to apple. Check your warranty.
