proximity sensor?/earpeice problem

I've got a iphone4 32gb I bought used online ,I'm having a problem with my earpiece I believe .I can hear when listening to my voice mail but can hear anything with making a call with or without headphones in so I know it's not a broken speaker ,anyone know if this is software related or know a fix ?

It's probably hardware. Have you checked the Apple site to see if your serial number is still under warranty?
