Default Risk of buying used jailbroken iPad2 ?

I see many for sale in classifieds, but wondering what the risks vs the lower cost
is if I could swing the ability to buy one?

I found a local guy wanting 3 bills for a jailbroken iPad 2 - 16GB
running 4.3.3

Does this seem like a fair price - originally bought in April 2011.

Its still under factory warranty so not much risk. If something is wrong, restore it and take it to Apple.

That's what I was thinking, but if I had to restore, would Apple Store fix for free since I wasn't original buyer if something went wrong?

Warranty transfers with Apple. I verified that with a iPod Touch I once had to swap. They told me they don't care who the owner is. All they care is that you are within the warranty period.
