How do I be assured my photos are in the iCloud when I don't see them in the iCloud icon?

I want to delete old photos from my photos from my phone and I have the iCloud Drive on but when I touch the icon, nothing is there.

iCloud and I loud Drive are not the same. Your photos, if set correctly, can be synced to iCloud, specifically your iCloud Photo Library. Anyway, you can login to iCloud via a computer, select the iCloud Photo Library option and then view the pics that are displayed therein. As for deleting old photos from your phone, simply go to the native Photos app and delete them. Note: if your pics are synced to iCloud, the photos you delete from your iPhone will also be deleted from iCloud and vice versa.
