Why can't I sign into my iCloud account on my brand new iPhone help?

i cant sign into my icloud account on my brand new iphone help!

i got a brand new iphone that has never been used before and this keeps popping up when i try to log into my (already created) icloud account
"Cannot Sign In

The maximum number of free accounts have been activated on this iPod touch."
ive heard many things about used iphones and ipods but this doesnt make sense because it is brand new! and ive already reset it and wiped it clean and did everything as a new phone but when i log into icloud this message pops up... plz help :crying:

Did you get it at an Apple Store? I'd take it back to the point of purchase...something isn't right with the device.

Is very likely that your "brand new" idevice is refurbished.
