The volume on my iPhone

So, I have had an iPhone 4 for about 2 years, and don't get me wrong, but it's not a very good phone anymore. It can get stupid. But my volume has NEVER stayed on my screen for about 2 hours and not going away. I can't get iOS 7 on it either. And I can't reset it or shut it off because my lock screen button is jammed and I do use accessive touch but if I turn it off, it won't turn back on. Please help me! I mean, I'm only keeping it for another 2 months but it's sooooo annoying! Help me please!

Restore using iTunes to fix the volume problem. It could also be that the volume button in jammed.
