I'm looking for software that will run in the background and will simply tell me if my 10 year old's iphone (being used as an Ipod) was being used at certain times when not allowed (for instance, when it's bed time and light's out at 9). I don't need it to check calls out, location, sms, etc... Something simple and cheap/free. Does such a thing exist?

I dont know of any app for that, but one of the easiest things to do is probably to enable parental restrictions in your router. Most routers have the ability to do this by MAC address, so you could set it up to allow no internet access to her device after 9pm or whatever. This won't prevent her from playing a game that does not need an internet connection though.
